Les juges ont en effet estimés que le signe " € " constitue un symbole représentant la monnaie unique européenne, en vertu d'une convention arbitraire, mais ne correspond nullement à une graphie usuelle ou ancienne de la lettre " E ".

En conséquence, le signe " € ", ne pouvant être assimilé à la lettre " E ", rend impossible le classement de la société dans le fichier alphabétique du RCS. D'où la non autorisation de ce signe.

NOTA : Il me semble toutefois utile de souligner que l'utilisation de signes dans la dénomination sociale des sociétés est tout à fait permise dès lors qu'ils ne font pas obstacle au classement dans le fichier du RCS. Il a ainsi été jugé que le signe " @ " (arobase) peut valablement être incorporé dans la dénomination sociale d'une société du fait qu'il peut être assimilé à la lette " A ".
